This document sets out the conditions governing the use of the website www.kasa.coffee (hereinafter, the “website”) and the purchase of products through it.
Please read these conditions and our Privacy Policy carefully before using this website. By using the website or placing an order, you declare that you are aware of and accept these conditions. If you do not agree with them, please do not use this website or place orders through it.
As the owners of this website, we reserve the right to modify this Purchase Policy at any time, as well as the commercial offer presented (products, prices, promotions and other commercial and service conditions). The conditions in force at the time of placing the order, or failing that, at the time of using the website will apply. For this reason, we recommend that you consult this Policy periodically and, in any case, before making a new purchase.
The information or personal data that you provide will be processed in accordance with the provisions of our Privacy Policy. By using the website or placing an order, you declare that all the data you provide are truthful, accurate and correspond to reality.

2. USE OF THE WEBSITE
By using this website and/or placing orders through it, you agree to:

Use the website only to make legally valid enquiries or orders.

Not place false or fraudulent orders. If we reasonably consider that such an order has been placed, we will be entitled to cancel it and inform the competent authorities if appropriate.

Provide us with your email address, postal address, telephone number and other contact details truthfully and accurately.
By placing an order through the website, you declare that you are over 18 years of age and have the legal capacity to enter into contracts.
3. TERRITORIAL SCOPE AND LANGUAGE
This website is mainly aimed at users residing in Spain and adapted to Spanish legislation. The main language of the website, this Purchase Policy and the purchase process is Spanish.
If other countries or languages are enabled in the future, this will be expressly indicated on the website.
4. PURCHASING SYSTEM
To place an order, you must follow the online purchase process:

Browse the different sections and select the products you are interested in (whole bean coffee, ground coffee, accessories, etc.).

Add them to the “shopping cart”. Until the time of payment you may modify the contents of the cart, remove products or change quantities.

Provide the necessary information for shipping and billing.

Review the order summary, including a breakdown of prices, taxes and shipping costs, before confirming the purchase.

Select the payment method available at that time.

Accept this Purchase Policy and complete the payment process (“checkout”, “pay now” or equivalent button).
It is not mandatory to register as a user to make a purchase, although you may create an account to facilitate future purchases.
The sales contract shall be deemed to be concluded at the moment you complete the payment process and receive order confirmation.
Kasa will keep a record of the purchase transactions carried out through the website, which may serve as proof of the transactions made.
5. PURCHASE CONFIRMATION
Once the purchase process has been completed, an order summary will be displayed on the screen and we will send confirmation to the email address provided. In this confirmation you will be able to see:

Products purchased and quantities.

Total price (including taxes and shipping costs).

Delivery address and, where applicable, billing address.

Contact details for customer service.

6. PRICE AND PAYMENT
All prices shown on the website are expressed in euros (€) and include the Value Added Tax (VAT) applicable at any given time, unless expressly stated otherwise.
Shipping costs, where applicable, will be shown separately before completing the purchase.
Prices may be changed at any time, but such changes will not affect orders for which you have already received confirmation.
Payment methods
The available payment methods will be indicated during the purchase process and may include, by way of example but not limitation:

Credit or debit card, through a secure payment gateway.

Other electronic means (e.g. online payment platforms) as may be indicated from time to time.
In no case will we have access to the full details of your card or payment method; these will be managed directly by the relevant payment service provider.
If there are any fees or charges associated with certain payment methods, they will be clearly displayed before completing the purchase and will never exceed the actual cost incurred by Kasa for their use.
7. PRODUCT AVAILABILITY
All orders are subject to product availability. If, once the order has been placed, there is any issue with stock or supply (for example, an out-of-stock product), we will contact you as soon as possible to:

Offer you a product with equivalent or similar characteristics, or
-
Proceed with the refund of the amount paid using the same means of payment used for the purchase, without undue delay and, in any case, within 14 calendar days from the date on which we inform you of the impossibility of fulfilling the order.
8. SHIPPING AND DELIVERY
Orders will be shipped to the delivery address indicated during the purchase process.
The estimated delivery times will be shown during the purchase process. These times may vary depending on the delivery address, product availability and the operation of the transport company.
If, for reasons beyond Kasa’s control, it is not possible to meet the initially estimated delivery date, we will inform you of this situation and you may choose between:

Continuing with the purchase by setting a new estimated delivery date, or
-
Cancelling the order with a full refund of the price paid.
For the purposes of this Policy, delivery shall be deemed to have taken place when you or a third party designated by you take material possession of the products, which may be evidenced by a signature or delivery record by the transport company.
In the event that you are not at home, the transport company may leave a notice or contact you to arrange a new delivery.
9. INVOICING
Unless you request otherwise, delivery of the goods shall be deemed to take place in the territory where Spanish VAT applies if the delivery address is in mainland Spain or the Balearic Islands. The applicable VAT rate will be that in force at any given time and depending on the product.
We may issue the invoice in electronic format, which will be sent to the email address provided. You may request a paper invoice at any time by sending an email to hola@kasa.coffee.
10. RETURNS, COFFEE AND ACCESSORIES
At Kasa we distinguish between:

Coffee products (whole bean or ground).
-
Accessories (equipment, utensils, etc.).
10.1. Whole bean coffee and ground coffee
We work with specialty food products, so we must ensure their safety, traceability and hygiene.
As a general rule, we do not accept returns of coffee due to a change of mind, personal taste or other similar reasons, without prejudice to any rights you may have as a consumer.
However, and without limiting your legal rights:
-
If the whole bean coffee packaging is sealed, has not been personalised and you are a consumer within the European Union, you may exercise your right of withdrawal within 14 calendar days from delivery, provided that the product is in perfect condition, unopened and in its original packaging.
-
Coffee ground at the customer’s request (grind selection or other personalised instructions) is considered a product made to the consumer’s specifications and, in accordance with consumer regulations, is not subject to withdrawal once prepared, except in cases of defects or shipping errors.
-
In all cases, any coffee product that has been unsealed (opened) cannot be returned for reasons of health and hygiene protection, unless it is defective or does not match the order placed.
If the coffee arrives damaged, in poor condition, or does not match what you ordered, you must contact us immediately at hola@kasa.coffee, attaching photos if possible and indicating the order number. We will review the case and offer you an appropriate solution (replacement, refund, etc.).
10.2. Accessories: 30-day policy
For accessories, you have a period of 30 calendar days from receipt of the order to request a return.
For us to accept the return, the item must be:
-
In the same condition in which you received it.
-
Unused.
-
With the original tags and packaging.
-
Accompanied by proof of purchase (order number, invoice or receipt).
11. HOW TO START A RETURN
To start a return (for accessories or, in legally permitted cases, for coffee):

Order number.

Product(s) you wish to return.

Reason for the return.

We will let you know whether the return is appropriate and, where applicable, the shipping address:

Unless we state otherwise, the direct return costs (shipping) will be at your expense.
Returns that have not been previously notified and authorised by email will not be accepted.
12. RIGHT OF WITHDRAWAL (EU CONSUMERS)
If you are a consumer and the order is shipped within the European Union, you have a period of 14 calendar days from receipt of the products to withdraw from the contract without giving any reason, in accordance with consumer protection regulations, except in cases of legal exceptions (for example, personalised products, goods unsealed for hygiene or health reasons, etc.).
To exercise this right, it is sufficient to notify us of your decision to withdraw from the contract by sending an email to hola@kasa.coffee within the indicated period. You may use a model withdrawal form, although this is not mandatory.
Once we have received your withdrawal and, where applicable, the returned products, we will proceed with the refund under the terms set out in the following section.
13. REFUNDS
Once we receive the returned products, we will inspect them and inform you whether the refund has been approved.
If approved:

We will issue the refund without undue delay and, in any event, no later than 14 calendar days from the date on which you informed us of your decision to withdraw or from the date on which we confirm acceptance of the return.

We may withhold the refund until we have received the goods or until you provide proof of their return, whichever occurs first.

The refund will be made using the same payment method used for the purchase, unless expressly agreed otherwise.
In the case of returns due to defects, faults, or receipt of an incorrect product, we will also refund, where applicable, the initial shipping costs and the return costs, in accordance with applicable regulations.
If more than 14 days have passed since we confirmed acceptance of the return and you have not received the refund, please contact us at hola@kasa.coffee.
14. WARRANTIES
If you are a consumer, you are entitled to the legal warranty established in the consumer protection regulations for consumer goods, under the terms and within the periods laid down by law at any given time.
Products shall be deemed to be in conformity when:

They match the description given on the website.

They are fit for the uses for which products of the same type are ordinarily intended.

They present the usual quality and performance of a product of the same type.
In the event of a lack of conformity, you must notify us within a reasonable time from when you became aware of it by writing to hola@kasa.coffee.

We do not guarantee uninterrupted availability of the website, although we will endeavour to avoid interruptions and, where reasonably possible, give prior notice of them.

Kasa shall not be liable for any damages arising from interferences, omissions, interruptions, computer viruses, failures or disconnections of the system caused by reasons beyond Kasa’s control.

Our liability in relation to any product purchased through the website shall be strictly limited to the purchase price of such product, unless otherwise provided by law.
17. DATA PROTECTION
We guarantee the protection of your personal data at all times in accordance with applicable regulations. You can consult detailed information on the processing of your data in our Privacy Policy, available on the website.
18. APPLICABLE LAW AND JURISDICTION
This Purchase Policy is governed by Spanish law. In the event of a dispute, and insofar as consumer regulations so provide, the parties shall submit to the courts and tribunals of the consumer’s domicile.
In any case, you may first resort to the out-of-court consumer dispute resolution mechanisms available to you (Municipal Consumer Information Offices, Consumer Arbitration Boards, etc.).
